AI Ethics and Professional Responsibility
A look at how legal ethics and professional responsibility apply when using AI tools in practice. This course covers key ethical duties including competence, diligence, confidentiality, and supervision, as well as practical issues like client communication, billing practices, and court requirements when using AI in legal work.
During the session
Part 1: Knowledge Check
Ask attendees these questions to ensure they understand the topic:
- How does the emergence of recent AI tools compare to previous technological advances in law from an ethical perspective?
- What does the duty of technological competence mean in the context of AI tools?
- When and how should lawyers communicate with clients about their use of AI tools?
- What specific considerations apply to maintaining client confidentiality when using AI tools?
- How should lawyers approach billing for work that involves AI tools?
Part 2: Group Exercise
Lead a group discussion based on the exercise. To encourage collaboration, divide the attendees into groups to discuss the exercise, then have a representative from each group summarize their views to the larger group. Call on people to share their thoughts and ask others to respond.
Tip for remote sessions: use your web conferencing system's breakout room feature to divide people into groups.
Part 3: Practical Implementation
Share your own experiences and guidance, including:
- General practice tips (dos and don'ts)
- Firm-specific guidance and practices
